First and foremost, if you are in imminent danger, do not call your attorney - call the Police! Thereafter you can call your attorney.


We will discuss what domestic violence is and how the justice system can provide protection. Domestic violence is defined in legislation to include several acts. The most prevalent being the following:

a.    Physical abuse;

b.    Sexual abuse;

c.    Emotional, verbal and psychological abuse;

d.    Economic abuse;

i.    This includes unreasonably withholding money to with the other party is entitled, or requires out of necessity (particularly the household), and bond instalments or rent; and

ii.    Unreasonably disposal of property to which the other party has an interest.

e.    Intimidation;

f.     Damage to property;

g.    Any other controlling or abusive behaviour.


If you are the victim of domestic violence the Domestic Violence Court can offer you protection in the form of a Protection Order. The Protection Order will list specific acts the offender may not do, under the penalty of being arrested and facing criminal charges.
